Unless Zeigangel has separately agreed in writing to confidentiality, you should not assume that unsolicited information submitted through general website-related communications will be treated as confidential.

Do not send trade secrets, sensitive personal information, regulated information, credentials, proprietary technical information, or other information requiring special protection through general website-related email addresses unless Zeigangel has expressly authorized that method of communication.

ZEIGANGEL DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, RELATING TO THE SITE OR ITS CONTENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

ZEIGANGEL DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT INFORMATION ON THE SITE WILL AT ALL TIMES BE COMPLETE, ACCURATE, OR CURRENT.

Nothing in this section excludes warranties or rights that cannot lawfully be excluded.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZEIGANGEL AND ITS AFFILIATES, OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SITE OR YOUR RELIANCE ON SITE CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,

ZEIGANGEL'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

The limitations in this section apply regardless of the theory of liability and even if Zeigangel has been advised of the possibility of such damages.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Zeigangel and its affiliates, officers, directors, members, employees, and agents from and against claims, liabilities, damages, losses, and reasonable costs and expenses arising from your material violation of these Terms, your unlawful use of the Site, or your infringement or violation of another person's rights through your use of the Site.

14. Governing Law

These Terms and any dispute arising out of or relating to the Site or these Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

Subject to applicable law, any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction and venue of those courts.

When we make changes, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by applicable law.

Zeigangel's failure to enforce a provision of these Terms does not waive its right to enforce that provision or any other provision.

These Terms constitute the agreement between you and Zeigangel concerning your use of the public Site, except to the extent another written agreement between you and Zeigangel expressly governs the matter at issue.
